Terms of Service

These Terms of Service ("Terms") govern your use of Vibe Cook (the "App"), operated by Zack Katsiroubas ("we", "us"), based in Ontario, Canada. The App is offered in Canada and the United States. By creating an account or using the App, you agree to these Terms and to our Privacy Policy.

1. Not medical or dietary advice

Vibe Cook's recipe suggestions, ingredient information, and dietary guidance are generated by artificial intelligence and are not reviewed by a nutritionist, dietitian, allergist, or medical professional.

The App can be wrong about what's in an ingredient or how a substitution affects a dish. If you have a food allergy, intolerance, or a medically necessary diet, you are responsible for independently verifying every ingredient — including reading product labels yourself — before you eat anything based on the App's suggestions. Do not rely on Vibe Cook as a substitute for professional medical or dietary advice. Use of the App for anyone with a serious allergy or medical dietary restriction is at that person's own risk.

2. Who can use Vibe Cook

You must be at least 13 years old to create an account or use the App. By using the App, you represent that you meet this requirement.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Tell us right away if you believe your account has been accessed without your permission.

We may suspend or terminate your account if you violate these Terms.

5. Your content

Recipes you save, photos you add to them, and any information you enter into your kitchen profile, belong to you. Only add photos you took or have the right to use. By saving content in the App, you grant us the limited right to store and process it solely to provide the App's features to you (for example, including your saved recipe titles in the context sent to OpenAI when you chat).

AI-generated content. Recipes and chat responses are generated by an AI model. We do not guarantee that AI-generated recipe content is original, accurate, or free of similarity to existing published recipes, and we make no ownership or exclusivity claims over AI-generated text on your behalf or ours.

6. Account termination and your data

You may delete your account at any time from Settings → Delete account (Settings is in My Kitchen, under "Account & more"). This immediately and permanently deletes your account, kitchen profile, chats, saved recipes and recipe photos, and cannot be undone. It does not cancel a Full Kitchen Access subscription; cancel that with Apple first (see §7).

We may suspend or terminate your account for violation of these Terms, or discontinue the App entirely. If we discontinue the App, we will provide reasonable notice where possible and you will be able to delete your account and request your data before the shutdown, consistent with our Privacy Policy. If we discontinue the App, we will stop renewing subscriptions, and you can ask Apple for a refund of any unused paid period (see §7).

7. Subscriptions and payments

What's free. Without a subscription, you get two free chats with Rosie every 7 days, with up to 5 messages in each. The 7 days start with the first chat's first message. You can save the recipes they make, and your Kitchen, Cookbook and Settings stay available. We may change the free allowance in the future.

Full Kitchen Access. Chatting beyond the free allowance needs a subscription called Full Kitchen Access, sold as an auto-renewing subscription through Apple's In-App Purchase:

Prices in other countries are set by Apple in your local currency, and the price you'll pay is always shown in the App and on Apple's purchase screen before you confirm. Prices may include applicable taxes, as determined by Apple.

Free trial. New subscribers can try Full Kitchen Access free for 3 days. Apple allows one free trial per Apple Account. If you don't cancel at least 24 hours before the trial ends, your Apple Account is charged for the plan you chose when the trial ends, and the subscription continues from then on.

Auto-renewal. Your subscription renews automatically at the end of each month or year, and your Apple Account is charged within the 24 hours before the current period ends, unless you cancel at least 24 hours before the end of that period. It renews at the same price unless the price changes (see below).

Cancelling. You can cancel at any time in your iPhone's Settings › [your name] › Subscriptions, or in the App at Settings › Subscription › Manage subscription. When you cancel, you keep Full Kitchen Access until the end of the period you've paid for (or the end of your trial) and aren't charged again. Deleting the App or your Vibe Cook account does not cancel your subscription; only cancelling with Apple does.

Refunds. Payments are processed by Apple, not by us, and we can't issue refunds ourselves. To ask for a refund, use Apple's Report a Problem page (reportaproblem.apple.com); Apple decides refund requests under its own policies. If Apple refunds a purchase, Full Kitchen Access for that purchase ends. We don't give refunds or credit for the unused part of a subscription period after you cancel, except where the law requires it.

Price changes. If we change the price of a subscription, Apple will tell you in advance and, where Apple or the law requires it, ask for your agreement before charging the new price. If you don't agree, you can cancel before the new price applies.

Failed payments. If Apple can't charge you at a renewal of a paid subscription, you keep Full Kitchen Access for up to 16 days while Apple retries. If the payment still doesn't go through, access ends. This extra time doesn't apply when a free trial is converting to a paid subscription.

Your subscription belongs to your Apple Account. It's tied to the Apple Account that bought it and to one Vibe Cook account at a time. If you use Restore Purchases while signed in to a different Vibe Cook account, the subscription moves to that account, and the account it left loses Full Kitchen Access. Family Sharing is not available for Vibe Cook subscriptions.

Usage limits. Full Kitchen Access has limits on how much you can use Rosie in a day, a week and a rolling 30 days. They're set well above normal cooking use, and they're there to keep the service running and to prevent abuse. If you reach one, the App tells you, and you can pick up again as the limit resets. Full Kitchen Access is not unlimited use.

Changes to Full Kitchen Access. We may add, change or remove features. If we make a change that materially reduces what a paid subscription includes, we'll tell you in advance, and you can cancel before your next renewal.

Free access. We may give some accounts free access (for example, beta testers) at our discretion. We can end that free access at any time; it never turns into a paid subscription without you choosing to buy one.

Your rights. Nothing in this section limits any rights you have under the consumer protection laws that apply to you.

8. The App Store

If you got the App from Apple's App Store, Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies to your use of the App. These Terms are between you and us, not Apple. Apple isn't responsible for the App, its content, its maintenance or support, or any claims about it; those are ours. If these Terms and Apple's agreement conflict about your license to use the App, Apple's agreement wins for that point.

9. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App — including any adverse reaction to food prepared based on the App's suggestions. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You and we agree to submit to the exclusive jurisdiction of the courts located in Ontario.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the App after changes take effect means you accept the updated Terms.
